Everson v. Board of Education (1947) was a landmark U.S. Supreme Court decision on the First Amendment’s establishment clause. Applying this provision to state governments via the 14th Amendment’s due process clause, Justice Hugo Black famously suggested in the opinion that the American Founders meant to erect a high and impregnable “wall of separation“ between church and state. This seminar will examine this 5-4 ruling, discuss the majority and dissenting opinions, and consider the long-term impact of the decision on American politics and First Amendment jurisprudence.
